Problem with my dell streak?

I bought my dell streak 2 days ago and i had this message that the widgets keep failing. And i woke one day to find that my L from the back cover fell off. I opened the back cover and found out that there was scars that looks like burns in the battery compartment can i change it with my telco or Dell?
